Our practice includes prosecution and defense of claims between companies based in contract and in tort, construction litigation, actions against corporate management, corporate dissolution, lender's rights, debt collection and creditors' representation in bankruptcy proceedings. Each of the attorneys has a strong commercial litigation practice, and Mr. Young carries a concentration in this area. Real Estate Transactions and Litigation
The firm has extensive background in real estate litigation, including boundary disputes, easement/access disputes, foreclosures, landlord-tenant disputes, mineral claims, quiet title actions, condemnation and re-zoning matters. Transactions include simple purchases and sales of land, title review and clearance, and secured owner-financing agreements. Each of Mr. Jensen and Mr. Houston carry real estate transactions and litigation practices, and Mr. Young concentrates his practice on these matters.
Our domestic practice concentrates on protecting the rights of clients in divorce, custody, visitation, child support, property division, guardianships and adoption. We always attempt to negotiate a resolution for our clients, and believe that even where an agreement cannot be made, family law can and should be free of unnecessary drama. Each of Mr. Jensen, Mr. Young and Mr. Houston practice in this area, and Mr. Houston regularly handles complex adoption issues.
Wills, Trusts and Probate Estates
The firm's practice includes drafting of simple wills and health care directives, to re-titling real estate so that it will pass to the owner's designee, to creation, funding and operation of trusts. The firm represents parties in contested and uncontested probate proceedings, and is often retained to handle ancillary administration for a foreign decedent. Each of Mr. Jensen, Mr. Young, and Mr. Houston practice in this area.
Business Planning and Transactions
Our practice includes formation and qualification of various businesses, purchasing ongoing businesses, mergers, dissolution, shareholder agreements, employment agreements, non-compete agreements, and supply agreements. Often business succession planning is combined with estate planning so that businesses can continue uninterrupted on the passing of a key person. Mr. Young maintains a practice concentration in this area.
Negligence and Tort Litigation
The firm represents both persons who have been injured in vehicle accidents or have otherwise been victims of negligence or medical malpractice. The firm also represents certain insurers in defense of negligence actions and Workers Compensation claims. Cases range from automobile negligence to premises liability. Mr. Jensen, who is a former insurance adjuster, maintains both plaintiff's and defense practice concentrations in negligence claims.
Social Security/Disability/Worker's Comp
The firm has assisted thousands of clients with navigating the maze of government filings, hearings, and appeals in Social Security, Social Security Disability, Medicare and Worker's Compensation cases, and also unemployment appeals. Representation includes individuals, companies and insurers in these cases, and the firm is often retained following the first unfavorable ruling to prosecute appeals in these areas. Mr. Jensen maintains a vigorous practice concentration in this area.
The firm represents the criminally accused in both state and federal courts. At the client's direction the firm will attempt to arrive at an acceptable plea bargain with the State, while providing a vigorous defense against unfair or unjust charges brought by it. Mr. Houston, a former deputy prosecutor, and Mr. Jensen each practice in criminal law.
The firm has represented individuals, quasi-governmental entities and municipalities in matters concerning good governance, freedom of information act requests, financing, eminent domain, procurement and contracting, re-zoning, pre-annexation agreements, discrimination in providing services, and other areas of municipal law. Mr. Houston is currently enjoying his second term as the City Attorney for the City of Benton, and devotes a considerable amount of his practice to such issues. Mr. Young represents several improvement districts, property owners' associations and Saline County's largest public water authority.
